We provide services (“Services”) in connection to creating reports detailing your income and expenses through our website.

Please read the terms of service (“Terms”) detailed below which apply when you use our Services. Using  of our services means you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use our Services. We recommend that you print a copy of these Terms for future reference.

Registering an Account

Your wealth advisor or Independent Financial Adviser (“IFA”) (each a Provider”) will issue a link via secure email inviting you to create an account. Once you have created your account (“Account”) on our website you can create your report detailing your income and financial outgoings (“Wealth Assessment”). Each request made to create a Wealth Assessment, and our Services is subject to these Terms.

When you create an Account:

  • You must register consent through our website before you can use our Services;

  • When you access account information from the financial providers you connect to your Wealth Assessment, your consent is required; and

  • Consent is required to finalise your Wealth Assessment and disclose it to your Provider.

Our product allows you to amend any anomalies before finalising your Wealth Assessment and disclosing it to your Provider. You are responsible for ensuring the completeness and accuracy of your Wealth Assessment submission. Please check your request and Wealth Assessment thoroughly before submitting it. We are not liable for any reliance placed on the Wealth Assessment by your Provider based on the information that you have provided.

Our Services

We provide individuals with an analysis of their income and expenditure by aggregating bank account (s) transaction data.

You may have obtained access to the Services through your Provider who has paid for your access to these Services; therefore, you may be subject to additional terms defined by your Provider.

We will obtain on your behalf, as an FCA regulated business, your bank account(s) transaction data, and aggregate and summarise your income and expenditures. We will hold this information on our system for 30 days after completion of the Wealth Assessment and make this available to you via your Account.

The Wealth Assessment provided to you as part of our Service can only be as up-to-date, complete and accurate as (i) the information supplied to us by you in relation to your bank account information, and (ii) other third parties we use to obtain this information. It should be noted we do not check the information we receive for accuracy or completeness, and we are not responsible for any inaccuracy or incomplete information within the Wealth Assessment.

We shall use commercially reasonable endeavours to make the Services available 24 hours a day, seven days a week, except for planned maintenance carried out during normal business hours, or unscheduled maintenance.

Our Services are directed only to people over the age of 18 years, residing in the United Kingdom.

Your Obligations

It is your responsibility to ensure that:

  • the information you provide is  accurate, up-to-date and complete.

  • You must keep any username, password, or other piece of information provided to you as part of our security procedures confidential.

  • You should not share or transfer this information with any third party. You must notify us immediately if you know or suspect that anyone other than yourself knows your username or password.

  • You must not misuse the Services by knowingly introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Services. If you do so, your right to use our Services will cease immediately. 

  • You must not attempt to decompile, reverse compile, disassemble, reverse engineer all or any part of the Services or attempt to obtain or assist third parties in obtaining access to the Services other than as provided in these Terms.

Termination

We reserve the right at any time to terminate your agreement with us, and your use of  our Services, immediately upon giving you notice in writing via the email address provide at time of registration of your account.

We have the right to cancel to Services where;

  1. your Provider or IFA determines you are not sanctioned to use the Service

  2. your Services access period expires; or

  3. your Provider or IFA ceases to pay for you to access the Services.

Termination of the contract will in no way affect either party’s rights or remedies that have accrued as at the termination.

Disclaimers of Representations and Warranties

While we aspire to provide the best service we can, the content, all Services are provided on an “as-is” and “as-available” basis. We make no representations, warranties or guarantees, whether express or implied, regarding the accuracy, reliability or completeness of the content of the Services.

We expressly disclaim any warranties of non-infringement or fitness for a particular purpose.

Intellectual Property Rights

The Services and all the content (images, website, appearance, design, videos and aesthetics) within them are protected by copyright laws and treaties around the world. The content contained within the Services and all the intelligent property rights in our Services are either owned by or licensed to us. All such rights are reserved to us.

Excluding the Wealth Assessment, you must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you cannot use the content on our site for any commercial purposes without first obtaining a licence to do so, whether from us or our licensors.

Agreement Modifications

Modifications to these Terms may occur from time to time. Revised Terms will always be published on our website, and will supersede previous versions. You will be bound by any modifications to the Terms when you use our Services after modifications have been published.

Complaints

We value ourselves on good customer service. Should our customer service not meet your expectations please email to tell us how we can help you.

We try to resolve complaints within 48 hrs of receipt of each complaint, but if we are unable to do this we will acknowledge that we have received the complaint, and give you an estimate of when we expect to resolve the matter.

Limitation of liability

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or, if at the time the contract was made, we both knew it might happen.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; or for fraud or fraudulent misrepresentation. Note that we provide our Services only for private use. You agree not to use our Services for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Where the website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you obtain from them. We have no control over the contents of those sites or resources.

Although we take all reasonable steps to protect our systems using virus checking software, please note that any content downloaded from the website is at your own risk. We do not guarantee that our Services will be secure or free from bugs or viruses or other infection which may damage, surreptitiously intercept or monitor any system, data or personal information.

We do not accept liability for any loss or damage that you suffer as a result of any distributed denial-of-service attacks, computer viruses, trojans, worms, software bombs or other damaging items resulting from your use of the website. You are responsible for protecting your computer systems from exposure to viruses by the use of anti-virus software, firewalls and any other technical measures necessary. Whilst we take reasonable steps to ensure that the content of the website is accurate, current and complete, we have no control over the content of the information provided by credit reference agencies or third party providers. We do not accept liability for the accuracy or completeness of the content provided as part of the Services. We do not accept liability for any errors or omissions or for the content becoming out of date.

Governing Law

These Terms and your relationship with Visible Capital under these Terms are governed by the Law of Scotland. You and we both agree that the Scottish Courts will have exclusive jurisdiction, except that if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
